In the November 2008 elections, Jan MacKay will be on the ballot as a candidate for the NC Senate, representing Senate District 15, which is a large part of Wake County, including Raleigh and Wake Forest.
The MacKay Senate candidacy is more than just part of a non-stop assault against the helmet laws, which Jan and other motorcyclists have been attacking from all possible angles. It is an effort to regain and secure other individual rights and liberties, in addition to our right to decide what we choose for our personal safety gear. Jan MacKay believes the only way to overturn the NC helmet laws requires attacking it on ALL fronts. On New Years Day, we circled the Governors Mansion in Raleigh, and had simultaneous protest rides in Wake County, Guilford County, Catawba County, and Gaston County, and were the top news story of the day in several areas across the state. In Charlotte, we collected over a thousand signatures onto petitions. On Patriots Day, we rode into the state Capital. On Opening Day of the Legislature, we rode circles around the legislative building, then delivered 2100 petition signatures. We have had more than a dozen protest rides all across the state. In 2007, Jan appeared before judicial committees in the legislative building and constantly lobbied the legislators by phone, emails, and personal visits, before turning to lawful acts of civil disobedience at the start of the new year in 2008. Jan was also ticketed, right outside NC State Highway Patrol Headquarters in Raleigh, for an alleged helmet violation. "The trooper darn near ran me down with his truck prior to pulling me over!" She will try to get the NC judicial system to rule the helmet laws to be unconstitutional, and will present motions to try and get the state to at least stop the troopers from running us over as they try to ascertain probable cause. She is prepared to represent herself pro se, with legal briefs, motions, and evidence including over 600 pages of documentation. Since many of the legislators in the NC General Assembly (NCGA) has such complete disregard for individual liberties and the bill of rights, Jan put together an NC Candidates Analysis and Endorsements document which has attained top rankings on search engines. When she published it, and announced to the legislators that it received top rankings for such search terms as NC Candidates, suddenly the legislators began to take us seriously and respond. It has been interesting to see the groveling by some of those who voted to embed federal motor vehicle safety standard FMVSS 218 into the helmet law, claiming they didn't realize this has angered motorcyclists. Jan knows for a fact that she wrote to them constantly telling them she opposes both the current and proposed helmet law and asked them to not only vote against H563 but also to take this opportunity to repeal the helmet law. How come they now claim they didn't realize that motorcyclists don't like the mandatory helmet law?! They didn't realize?!!! Is this because there were many who followed the misguided advice of alternative safety bureaucrat wannabe's in the state MSO (motorcycle safety organization) writing in to say they DO like it? Several legislators have reported they remember hearing from more people saying they like the helmet law, and that they outnumbered the people who adamantly complained about the helmet law. That these legislators responded to the request of the masses of safety nannies who wrote to them saying they like helmet laws, is no excuse. Majority rule is not an excuse for stomping all over the Bill of Rights and Constitution. Amendment 14 , simply put, says no state shall make or enforce vague laws which do not follow due process. Why weren't the NC legislators willing to give us the time of day until we created a document which became top ranked on the internet, in order to obtain a bit of political clout? !!! When legislators respond only to a majority view, or money, or when the truth is revealed to the masses, they sit up and begin to listen. This is a travesty! Just because the federal government and the sissified masses in the post-911 world appear to be terrorized into no longer being concerned about the Bill of Rights, it does not give legislators an excuse to throw it, and the Constitution, out the window. Pull you head out of your (err...compliant helmets) and go back to being brave and proud Americans, freedom fighters, and BIKERS dammit! As such, Jan MacKay hopes that as NC Senator from Wake County, she will be able to work to restore adherence to the US and NC Constitution, from the inside. If Jan is not elected (the incumbent has something like a $600,000 campaign fund in order to keep a $20,000 per year job...haha, what does that tell you????!!!!!), she will continue to be adamant about insisting on a repeal of helmet laws, and will continue to work for other rights and individual liberties.
